Privacy Policy

  1. Introduction.

This is the privacy policy of Focus SUP Hawaii (“Focus”).  This seeks to inform you of our policies, practices and choices you can make regarding personal information we have about you. 

We try to respect your privacy. This policy says what we try to do. It is not a contract obligation by us. However, pursuant to the policy you grant consents, licenses, exclusions and limitations of liability.

Please review this policy. If there is any part you do not agree with, or if you do not think it provides enough protection, this policy tells you how to tell us. You can also exit this site and not stay or visit it. If there is information you do not consent to us receiving, collecting, using or sharing, you can tell us and can opt out. (Some information may have been collected from this visit. If you opt out, we will remove it, consistently with the policy).

  1. Collection of Personal Information.

We obtain information several ways. We try to limit information we obtain to only what is needed for the purposes we collect the information.  Here are types of information we collect and where it comes to us from. 

Voluntary disclosure. We collect information you provide, like your name, address, phone, email address, purchases, experiences, personal characteristics and preferences you tell us, compliments or criticisms, and any other information you tell us. 

You visiting this site discloses information. When you visit or use this site, we obtain data about you and the device you use. This can include your IP address, browser type, operating system and referring website address. We may collect information like date and time of your visit, pages you visit, order of pages and time on each page. These are examples. Technology may let us collect and store other kinds of data about your visit, use and activities at the site. 

Subscribing.  If you subscribe on our website to receive information from us (sales, news releases and other communications we may make to subscribers) we collect your email address.

Purchases and Returns. If you buy or return a product, we collect billing and address information and the product(s) involved.  We may record information on reason(s) for a return.

Event Registration. If you register to participate at an event we conduct, you will provide personal information in the registration process including name, address, phone and email and photograph. 

Applications.  If you apply for employment, or to be a distributor, wholesaler, affiliate, broker, reseller, sales representative or supplier, we will collect your name and email address and you may provide additional personal information in the application and application process. A job application, for example, provides us many kinds of personal information, such as your name, address, email address, phone number, tax id number, education and work history.

Comments. You can email or phone us or write to us at our address. Our email and mail address and phone number are provided in this policy. Our personnel also receive emails. We store these, including personal information you include, so we can respond or evaluate contents in the future.

We possibly collect other types of information not listed above, for example, metadata, and possibly new kinds of information have been derived since this policy was written or will be derived in the future that we may collect. Personnel could receive information from sources not categorized above, such as being told or seeing or hearing information from others, on the internet or other media, receiving unsolicited information, learning something in a discussion and noting it for reference, or any other ways information is received, noted and saved. 

Other Sources. We collect any information you enter on our site, or that your device provides to our site, or that you give us in any way or others give us any other way. People affiliated with us could see, read, hear or receive and potentially make note and collect information received in news and advertising media (broadcast, print, internet, social media) and oral and written communications with others, in the course of activities in roles for us or in personal activities.

If you directly disclose personally identifiable information or personally sensitive data through Focus public message boards, this information may be collected and used by others.

  1. Uses of Your Personal Information

We collect and use your personal information to operate and try to improve our website(s), fulfill transactions with you, deliver products you request, tell you about our products, select, develop and improve products and respond to inquiries.

We may use personally identifiable information to tell you about products available from us and our affiliates.

Resumé information and information in applications is used to make assessments in relation to becoming or remaining employed or becoming a distributor, wholesaler, affiliate, broker, supplier or having another business relationship with us.

Information we collect provides us data on use of the website. Referring website information tells us about other websites that refer visitors to our website. 

We may use information we obtain to do analyses of user behavior and characteristics to measure interest in and use of various areas of the site, or other purposes. New uses could emerge; in the future we could use information in ways or to do things we do not currently do.

  1. Sharing Personal Information

We do not sell, rent or lease customer lists to third parties in the ordinary sense of providing customer information to others in exchange for money so that they can advertise or solicit you to buy goods or services.

We may share data with service providers to help perform statistical or other analyses, send you email or postal mail, provide customer support, or arrange deliveries. We have agreements or understandings with the third parties that they do not use your personal information except to provide services to Focus, and that they will keep your information confidential.   We cannot assure they will abide by these agreements or understandings.

We may keep track of websites and pages users visit within www.focussup.com to assess interest and popularity of pages, contents of pages, and products. The data is used to analyze interests of visitors and to develop and deliver content and advertising to customers whose actions indicate they may have interest in a particular subject area.

We may disclose your personal information, without notice, if required by law or if we believe it is or may be necessary to comply with law; comply with legal process served on us or the site; protect or defend rights or property; act under exigent circumstances to protect safety. We may disclosure your personal information to voluntarily cooperate with law enforcement, government or public or private safety investigation or these or other requests. We may choose to cooperate with a government or public or private safety request or legal process or other request even if not legally required to. 

Third party service providers, such as service providers in web management, consulting, service and repair of our information technology equipment, access and usage, may have access to information you provide, in performing their services for us. 

We provide your name and address, possibly your phone number and any other information for the shipping label, to services that deliver products to you, such as the U.S. Postal Service, FedEx, UPS and any other delivery services.

If we were to merge, acquire or be acquired by another entity, or explore or agree to do so, the other party(s) or potential party(s) and their advisors would have access to information maintained through this site or other information in our possession. Another entity could have different policies, or could modify these policies.

The California Consumer Privacy Act defines “sell” in relation to personal information, more broadly, to include sell, rent, release, disclose, disseminate, make available, transfer or otherwise communicate that information orally, in writing or electronically to another business for money or other consideration.  Understood this way, we may be considered to have sold information to fulfillment companies we contract with to print and send printed advertising and marketing or delivery of products through the postal mail and email, or through their personnel, and to service providers who help us manage or operate this site or other information.

Our website may use cookies to help personalize your online experience. A cookie is a small file placed on your hard drive or device. One purpose of a cookie is to provide convenience to save you time. It tells the web server you returned to a specific page. It may help the server recall your information from other visits. This simplifies recording your personal information, like billing and shipping address. As an additional measure, this policy does not state more details of security measures we use. We do not claim to have the most advanced or best possible security measures. Neither our security measures, nor any security measures, provide 100% certainty against all risks. Inadvertent disclosure is possible. Technology changes, computer hackers, dishonesty by persons with access and human error are examples why it is impossible for us, or anyone, to absolutely guarantee your information cannot be accessed or disclosed.

We do not knowingly collect personally identifiable information from persons under age 18. If you are under this age, you must ask your parent or guardian for permission to use this website. If we learn we collected personal information from someone, without parental or guardian consent, who, at the time we learn this, is under 18, we will try to delete that information. Search engines and other Internet sites which provide links to this site or that you access from a link in this site, may have privacy policies or practices that differ from this policy. As one example, our site has a section named “Videos” that links to our Focus SUP Hawaii channel on YouTube and YouTube has its own privacy policy. Focus is not responsible for privacy practices or content of other sites. We encourage you to be aware when you come to or leave this site and read the privacy statements of each website that collects personally identifiable information. This policy applies only to information collected by this site or us.

  1. California Residents’ Rights

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (1) a list of categories of personal information, such as name, address, e-mail address, and type of services provided to the customer, that a business disclosed to third parties (including affiliates that are separate legal entities) in the immediately preceding calendar year for the third parties’ direct marketing purposes; and (2) names and addresses of all such third parties. The California Consumer Privacy Act, California Civil Code 1798.100, et seq. (CCPA) applies to some companies and their data collection practices, requiring transparency regarding data practices and lets people request, among other things, access to and deletion of personal information, and requires companies that are subject to such law, to provide people with control over certain data transfers deemed under the law to be a “sale” of data about them.  We may voluntarily comply with some provisions of CCPA. Our voluntary compliance is not an undertaking to be subject to CCPA where we are not obligated to do so.

Non-Discrimination: We will not discriminate against for making a request to us described anywhere in this policy.  We reserve our rights in the event requests are excessive or that we view as unreasonable.

Verifying a Request: Only you, or a person authorized to act on your behalf, may make a request related to your personal information. We require that a request be verifiable. If the request is made by someone acting on your behalf, that person must provide us verifiable proof of the authorization, such as a power-of-attorney signed by you and notarized, or a court order, granting such authorization to the person acting on your behalf.

Verifying a request will require you to provide information for us to reasonably verify that you are the person who we collected personal information about, or require you or a person authorized to act on your behalf to provide information for us to reasonably verify that authorization.

What We’ll Do: After we verify a request, we’ll try to do what you or the person authorized to act on your behalf, asked. There are limits. For example, a request to delete information may be declined if we consider it necessary to retain the information consistently with exceptions in CCPA. A record of your deletion request may be kept.

We intend to use personal information you provide in a verifiable request only to verify your request. We may not be able to or may choose not to respond to your request or provide you personal information if we cannot sufficiently verify your identity or authority.

We may decline to act on a request if the request is excessive, repetitive, or manifestly unfounded.

Your California Privacy Rights under the "Shine the Light" Law

Pursuant to Section 1798.83 of the California Civil Code (a separate law from CCPA), California residents have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the prior calendar year, including names and addresses of the third parties, and examples of the types of services or products marketed by those third parties.
